ZER Terms of Use

These Terms govern the use of ZER CRM as a business tool for repair shops and service companies.

  1. Service provider and subscription invoice issuer: SIA "FixLab", registration No. 40203523267, VAT No. LV40203523267, legal address Liepu aleja 38, Babīte, Babītes pag., Mārupes nov., LV-2101, Latvia, IBAN LV46HABA0551056093125.
  2. Early Access subscription: 10 EUR per month before taxes. VAT/PVN and other taxes may be added where legally applicable.
  3. The Early Access plan includes the client database, inventory management, sales and cash tracking, reports and analytics. Features may be improved or changed while the service remains in Early Access.
  4. The included plan allows one owner account and up to 3 employees. A fourth employee requires a plan change or separate written agreement.
  5. Subscription statuses may be trial, active, past_due, suspended, or cancelled. Access may be restricted when payment is overdue or the account is suspended.
  6. The account owner is responsible for employees, roles, permissions, passwords, lawful use of customer data, and correctness of entered data.
  7. Each company workspace is separated from other companies. Users must not attempt to access another company workspace or bypass permissions.
  8. ZER is an accounting and workflow tool. The user remains responsible for accounting, tax, repair, warranty, consumer and document decisions made with the data.
  9. To the maximum extent permitted by law, liability for the service is limited to the subscription amount actually paid for the last three months.
  10. The platform supervisor account is fixlablv@gmail.com and may access technical data only for support, security, recovery, abuse investigation or legal obligations.
  11. The agreement is concluded when FixLab approves the registration and activates the subscription. Invoices are issued monthly in advance; access may be suspended after the due date. Payments already covering an active period are non-refundable except where mandatory law requires otherwise.
  12. The owner may cancel before the next billing period by contacting fixlablv@gmail.com. The workspace remains available until the paid period ends unless suspended for a security breach, unlawful use or material breach.
  13. ZER is an Early Access business service without a guaranteed uninterrupted service level. FixLab applies reasonable care, security controls and backups, announces material planned maintenance where practicable, and is not liable for force-majeure events or failures outside its reasonable control.
  14. The customer owns its workspace data and grants FixLab only the rights needed to host, secure, back up and process it under the DPA. ZER software, design and documentation remain FixLab intellectual property.
  15. Before termination the owner should export required data. Active workspace data is deleted within 30 days after account deletion; encrypted backup remnants expire within 30 days. Accounting and security records may be retained where law or legitimate interests require it.
  16. Each party must keep confidential information confidential. Liability exclusions do not apply to wilful misconduct, gross negligence or liability that cannot be limited by law.
  17. Latvian law applies. The parties first attempt to resolve disputes by written negotiation; unresolved B2B disputes are submitted to the competent courts of Latvia.
  18. Material changes are announced to the account email before taking effect. Continued use after the effective date constitutes acceptance; if the customer disagrees, it may cancel before that date. The Latvian version prevails if translations conflict.
